Tattoo Consent Form

These Terms & Conditions ("Terms") apply to all tattoo consultations, design work, appointments and tattooing services provided by Artemis Tattoo Studio ("Artemis", "the Studio", "we", "us" or "our").

By booking an appointment, paying a deposit, attending an appointment, approving a design or signing our consent documentation, you ("the Client", "you" or "your") acknowledge that you have had the opportunity to read and understand these Terms and agree to be bound by them.

1. BOOKING AN APPOINTMENT

1.1 Appointments are subject to availability and are only confirmed once Artemis has accepted the booking and received the required deposit.

1.2 Appointment times are reserved specifically for each Client. The Studio therefore requires sufficient notice where an appointment needs to be rearranged.

1.3 The Client is responsible for providing accurate contact details and checking appointment confirmations and communications sent by the Studio.

1.4 Where a Client is booking on behalf of another person, the person receiving the tattoo must independently satisfy all applicable age, identification, consent and health requirements.

1.5 Artemis may require valid photographic identification before tattooing. If satisfactory identification cannot be provided where identification is required, the Studio may postpone or refuse the appointment.

2. AGE REQUIREMENTS

2.1 Artemis Tattoo Studio will only tattoo Clients who meet the Studio's minimum age requirements and all applicable legal requirements.

2.2 The Studio may request photographic identification to verify age and identity.

2.3 The Studio reserves the right to refuse or postpone tattooing where age or identity cannot be satisfactorily established.

2.4 Where a junior artist, apprentice or trainee is involved, separate consent and supervision requirements may apply. These will be explained to the Client before tattooing proceeds.

3. DEPOSITS

3.1 A deposit will be required in order to reserve the date and time of an appointment. Once a deposit has been paid, it cannot be reversed.

3.2 Deposits are taken specifically to reserve the artist's time and appointment date and may also cover work or costs incurred specifically in preparing for the appointment.

3.3 Deposits will be applied against the final cost of the tattoo unless otherwise stated at the time of booking.

3.4 If the Client cancels or requests to rearrange an appointment, the deposit will be retained in accordance with the cancellation provisions set out below.

3.5 Any cancellation or rearrangement will be charged at an amount equivalent to the cost of the deposit paid prior to the appointment.

4. CANCELLATIONS, REARRANGEMENTS AND NO-SHOWS

4.1 Artemis requires at least 72 hours' notice where a Client needs to rearrange an appointment.

4.2 Where less than 72 hours' notice is given, or where a Client does not attend their appointment, the deposit will be retained.

5. DESIGN WORK AND CHANGES

5.1 Tattoo designs are prepared specifically for the Client and may involve substantial artistic time and preparation.

5.2 The Client should communicate any important design requirements, changes, placement details, size requirements and reference material as early as reasonably possible.

5.3 Once a design has been prepared, substantial changes requested by the Client may require additional preparation time.

5.4 Where a substantial design change is requested on the day of the appointment, Artemis may charge an additional design/preparation fee. Where applicable, the Client will be informed of the charge before the additional work is undertaken.

5.5 The Client is responsible for checking and approving the final design, spelling, dates, names, symbols, numbers, placement and other details before tattooing begins.

5.6 Once the Client has approved the final design and tattooing has commenced, changes may not be possible.

5.7 Artemis does not guarantee that a reference image supplied by a Client can or will be reproduced identically. The final tattoo will be an original application of the agreed concept and may necessarily differ due to skin, placement, scale, technical limitations and artistic considerations.

6. PRICING AND PAYMENT

6.1 Tattoo prices may be based on the size, placement, complexity, style, artist, estimated time, materials and other factors.

6.2 Where a fixed price has been agreed, Artemis will generally honour that agreed price unless the Client requests additional work or a material change.

6.3 Where tattooing is charged by time, the final price may vary according to the actual time reasonably required to complete the agreed work.

6.4 The Studio will communicate any significant change to the expected price where reasonably practicable before undertaking additional chargeable work.

6.5 Payment for completed services is due at the end of the appointment unless otherwise agreed.

6.6 Additional work requested by the Client may incur additional charges.

7. HEALTH AND MEDICAL INFORMATION

7.1 Tattooing involves breaking the skin and carries inherent risks, including but not limited to bleeding, bruising, swelling, soreness, infection, allergic reaction, irritation, scarring, changes in pigmentation and variations in healing.

7.2 The Client must provide complete and accurate information relevant to the safety of the tattooing procedure.

7.3 The Client should inform Artemis of any relevant:

allergies or previous allergic reactions; reactions to tattoo pigments, metals, latex, adhesives, disinfectants or skincare products; medication, including blood-thinning medication; medical conditions; immune-system conditions or treatments affecting immunity; blood-clotting or bleeding disorders; diabetes; epilepsy or seizure disorders; heart or blood-pressure conditions; skin conditions; infections, rashes, inflammation, wounds or broken skin; pregnancy or breastfeeding; previous problems with tattooing or healing; and any other circumstance that may reasonably affect the safety or healing of the tattoo.

7.4 The Client should provide details of relevant medication, including dosage, where requested.

7.5 The Client confirms that the information provided to Artemis is accurate and complete to the best of their knowledge.

7.6 The Client agrees to notify Artemis if relevant health information changes before the appointment or before tattooing begins.

7.7 Artemis may recommend that the Client seek advice from an appropriately qualified medical professional before tattooing where the Studio considers this appropriate.

7.8 Artemis is a tattoo studio and does not provide medical diagnosis or medical advice. Any information provided by Artemis about potential tattooing risks is general information and is not a substitute for advice from a qualified healthcare professional.

8. RIGHT TO REFUSE, POSTPONE OR STOP A TATTOO

8.1 Artemis reserves the right to refuse, postpone, pause or stop tattooing where the artist reasonably believes that proceeding may be unsafe, inappropriate or unsuitable.

8.2 Circumstances may include, without limitation:

incomplete or inaccurate health information; illness or signs of infection; unsuitable, damaged, inflamed, sunburned or otherwise compromised skin; circumstances that may materially affect healing; the Client appearing intoxicated or impaired; the Client being unable to remain sufficiently still; behaviour that creates a safety, hygiene or welfare concern; aggressive, threatening, abusive or discriminatory behaviour; failure to follow reasonable hygiene or safety instructions; a change in circumstances that makes continuing inappropriate; or any other reasonable health, safety or welfare concern.

8.3 Where tattooing is stopped or postponed, Artemis will consider fairly whether any deposit, payment or other amount should be retained, taking into account the reason for the decision, work already carried out and any reasonable losses incurred.

9. TATTOOING RISKS AND HEALING

9.1 The Client understands that tattooing is permanent and involves intentionally inserting pigment into the skin.

9.2 The Client acknowledges that no tattoo artist can guarantee an identical healed result to a freshly tattooed tattoo, reference image, digital design or photograph.

9.3 Healing varies between individuals and may be affected by skin type, placement, lifestyle, immune response, sun exposure, aftercare, existing skin conditions and other factors.

9.4 Possible complications include infection, allergic reaction, inflammation, excessive scabbing, pigment loss, colour changes, scarring and other changes to the appearance of the tattoo.

9.5 The Studio will take reasonable care and follow appropriate hygiene and tattooing procedures. However, no tattoo artist can eliminate every risk associated with tattooing or guarantee a particular healing outcome.

9.6 The Client should seek appropriate medical attention if they experience symptoms that may indicate a significant infection, allergic reaction or other medical problem.

10. AFTERCARE

10.1 The Client agrees to follow the aftercare instructions provided by Artemis.

10.2 The Client should keep the tattoo clean and follow the Studio's instructions concerning washing, moisturising, protection and healing.

10.3 The Client should avoid actions that may unnecessarily interfere with healing, including excessive scratching, picking, soaking or exposing the tattoo to unsuitable conditions.

10.4 The Client acknowledges that failure to follow appropriate aftercare may negatively affect healing and the final appearance of the tattoo.

10.5 If the Client is unsure about the healing process or experiences a concern, they should contact Artemis promptly. Where symptoms appear medically significant, the Client should seek advice from an appropriately qualified healthcare professional.

11. TOUCH-UPS AND HEALED TATTOOS

11.1 Tattoo healing is individual and some tattoos may require a touch-up after healing.

11.2 A touch-up is not automatically guaranteed to be free.

11.3 Artemis may assess a healed tattoo before agreeing whether a touch-up is appropriate and whether a charge applies.

11.4 Touch-ups may be chargeable where the need for additional work is reasonably attributable to healing, aftercare, sun exposure, skin changes, the Client's circumstances, or factors outside the artist's reasonable control.

11.5 Certain areas, including hands, fingers, feet and other high-friction or high-movement areas, may naturally experience greater pigment loss and may require additional work.

11.6 Any complimentary touch-up policy offered by Artemis will be subject to the conditions communicated by the Studio at the time of tattooing.

12. PLACEMENT AND SUITABILITY

12.1 The artist may advise that a particular design, size or placement should be altered where reasonably necessary to achieve a safe or satisfactory tattoo.

12.2 The Client remains responsible for choosing their preferred placement, subject to the artist's professional assessment of whether the proposed tattoo can reasonably be carried out.

13. PHOTOGRAPHY AND USE OF IMAGES

13.1 Artemis may wish to photograph completed tattoos for portfolio, record-keeping, educational or promotional purposes.

13.2 Photography for promotional purposes should be subject to the Client's separate consent where required.

13.3 The Client may choose not to consent to promotional use of photographs. Refusing promotional photography will not affect the Client's ability to receive tattooing services.

13.4 Where photographs are taken, Artemis will take reasonable steps to avoid unnecessarily identifying the Client unless the Client has separately agreed to identifiable use.

14. ARTIST'S WORK AND INTELLECTUAL PROPERTY

14.1 Tattoo designs created by Artemis or its artists remain the intellectual property of the artist or Studio unless otherwise agreed in writing.

14.2 The Client receives permission to have the agreed design tattooed on their body.

14.3 The Client may not reproduce, sell, commercially distribute or use an artist's original design for another tattoo or commercial purpose without the artist's permission.

14.4 Reference material supplied by the Client must be provided lawfully and the Client should not ask Artemis to reproduce another artist's copyrighted work without permission.

15. JUNIOR ARTISTS, APPRENTICES AND TRAINEES

15.1 Artemis may provide tattooing services through junior artists, apprentices or trainees where appropriate.

15.2 The Client will be informed where a junior artist, apprentice or trainee is performing or materially assisting with the tattoo.

15.3 Where separate consent is required, the Client must provide that consent before the tattoo proceeds.

15.4 Appropriate supervision and Studio procedures will apply where a junior artist, apprentice or trainee is involved.

16. PERSONAL PROPERTY

16.1 Clients are responsible for their personal belongings while attending the Studio.

16.2 Artemis will take reasonable care of the Studio environment but cannot accept responsibility for loss or damage to personal property except where required by law.

17. PRIVACY AND PERSONAL INFORMATION

17.1 Artemis may collect personal information necessary to manage appointments, provide tattooing services, maintain appropriate client records, communicate with Clients, comply with legal or insurance requirements and protect the health and safety of Clients and artists.

17.2 Information concerning a Client's health is sensitive personal information and will be handled in accordance with applicable data protection law.

17.3 Artemis will only collect information that is reasonably relevant to the purposes for which it is required.

17.4 Access to Client information will be restricted to those who reasonably need it for legitimate Studio purposes, subject to applicable law.

17.5 Client information will be stored securely and retained only for as long as reasonably necessary, taking account of legal, insurance, business and record-keeping requirements.

17.6 Full details of how Artemis collects, uses, stores, retains and protects personal information are set out in the Studio's separate Privacy Notice.

17.7 Where Artemis relies on explicit consent to process health information as special category data, that consent will be obtained separately and expressly from the Client.

18. LIABILITY AND STATUTORY RIGHTS

18.1 Artemis will provide tattooing services with reasonable care and skill as required by applicable consumer law.

18.2 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

18.3 Nothing in these Terms affects the Client's statutory rights.

18.4 Artemis is not responsible for outcomes caused by information that the Client knowingly or negligently failed to disclose, failure to follow reasonable aftercare instructions, or circumstances outside the Studio's reasonable control, except to the extent that applicable law provides otherwise.

19. CHANGES TO THESE TERMS

19.1 Artemis may update these Terms from time to time to reflect changes in the Studio's services, procedures or legal requirements.

19.2 The Terms applicable to an appointment will normally be those in force and made available to the Client when the appointment is booked, unless a later change is required by law or agreed with the Client.

By booking an appointment with Artemis Tattoo Studio, I confirm that:

I have provided accurate and complete information relevant to my health and suitability for tattooing. I understand that I must follow the Studio's aftercare instructions. I understand that healing and the final appearance of a tattoo cannot be guaranteed. I understand the Studio's booking, cancellation, deposit and design-change policies. I understand that the artist may postpone, refuse, pause or stop tattooing where there is a reasonable health, safety, welfare or suitability concern.
